The Vision Council (TVC) released a statement following the US Supreme Court’s 6-3 decision that ruled President Donald Trump exceeded his authority under the International Emergency Economic Powers Act (IEEPA) in imposing broad global tariffs without clear congressional approval.
The ruling invalidates tariffs on imports from major trading partners that were enacted under IEEPA and reinforces limits on executive authority under the “major questions” doctrine. The decision is limited in scope to tariffs imposed under IEEPA and does not automatically affect duties enacted under other statutory authorities.
In response to the decision, President Trump indicated that his administration is evaluating alternative legal mechanisms to preserve certain tariff measures. He also announced plans to issue an executive order establishing a universal 10% tariff under Section 122 of the Trade Act of 1974. The scope, timing, and implementation details of any new tariff action will depend on the terms of the executive order.
TVC notes that the decision may prompt repayment claims from companies that previously paid the invalidated duties. Several multinational businesses, including US importers and manufacturers, have initiated legal challenges seeking refunds on the grounds that the tariffs were unlawfully imposed. However, any reimbursement process is expected to take time and may require affected companies to pursue administrative remedies or litigation.
Once the ruling becomes effective, US Customs and Border Protection (CBP) is expected to issue formal guidance and update its systems to cease collecting the invalidated tariffs on new entries. Implementation timelines may vary, particularly if the government seeks a temporary stay of the decision. Importers are encouraged to monitor official CBP communications for instructions regarding shipments in transit and recently entered goods.
